California Penal Code 148.9 PC makes it a crime to represent a false identity to any police or peace officer in California in order to evade the court process or simply avoid proper identification by the officer.
This section applies not only to giving the police a false or fictitious name but also to providing a false date of birth or any other false information.
On the other hand, the crime of identity theft requires that you commit some additional act beyond merely identifying yourself as another person.
Although the maximum penalty is 6 months in jail, a judge has discretion to impose much less jail time, or even no jail time. The final sentence depends on the defendant’s criminal history and the circumstances of the offense.
