This action brings serious consequences for the case, since the judge has the full legal authority to decide to issue a deportation in absentia.

What happens when a judge issues a deportation in absentia for arriving late or not attending the appointment with the judge in immigration court?

When a judge decides to place someone in deportation in absentia, at that point it becomes much more difficult to reopen the case and have the judge decide to reopen it again. In order to reopen a case in immigration court, you must have a valid justification based on immigration law.

The important thing is that if you have an appointment in immigration court, you must:

  • You must arrive at the scheduled time in order to be ready for your hearing.

As Hispanics, there are some people who do not take the time or do not take the seriousness of the case, and this carelessness can bring terrible consequences for your case. For example, if it were an asylum case, you could lose it.
