Legal Definition
This law prohibits a person from contacting or attempting to contact a minor (under 18 years old) with the specific intent to commit certain crimes.
In an effort to combat increasing incidents of internet predators, the California Legislature enacted Penal Code 288.3 in 2006. This crime is very similar to Penal Code 288.4 (“Arranging a Meeting with a Minor for Lascivious Purposes”) and Penal Code 288.2 (“Sending Harmful Material with the Intent to Seduce a Minor”).
The sanctions depend on:
- Which specified crimes under PC 288.3 you intended to commit
- Your criminal history
- Whether you are accused under state or federal law
Possible Penalties (formal probation or state prison):
- 16 months, 2 or 3 years in California State Prison
- A maximum $10,000 fine
Our criminal defense attorneys at Progresso Legal Group P.C. can help you understand this crime and provide representation.
