It is always important for parents to have legal support throughout the process and to know what child support guidelines the law establishes to calculate a fair payment for child support.

Below, we want to share a series of key points in child support processes.

First, we must make very clear that the purpose of a child support process is well defined: it is a monthly obligation where the parent pays support to their child and delivers it directly to the custodial parent on the dates established by the child support order issued by the court.

The State of California law establishes that children should enjoy a lifestyle on par with their parents, and the goal is that the child support payment minimizes the needs arising from the separation of a home or family division.

Similarly, when defining the amount to pay in child support, one of the factors considered is California’s high standard of living, from which the child support amount is established in all cases. Of course, the parents’ income is also taken into account.

How can we calculate child support?

To calculate child support, there is an algebraic equation that allows us to determine a fair and reasonable amount to pay. This algebraic equation has two basic factors, which are:

Likewise, there has always been a misunderstanding in these processes when people think that if there is equal shared time or equal incomes, child support should not be paid. However, one must consider that if both parents have the same income but one spends less time with the child, that parent must pay legal child support. Similarly, if both share equal parenting time but one earns more than the other, the higher earner is expected to pay child support.

Considering these factors helps avoid headaches when starting a child support process. Below, we present the formula used to calculate child support and what is taken into account to define the result.

The disparity of parents’ incomes.

The inequality in shared parenting time.

The greater the disparity in parents’ incomes, the higher the likelihood of establishing child support. For example, if one parent earns $100,000 per year and the other only $15,000 per year, the higher-earning parent must pay a considerable amount of child support. Conversely, if the parents’ incomes are relatively equal, the child support amount will be lower.

Regarding the inequality in shared time, the greater the disparity in time spent with the children, the higher the child support payment. For example, if one parent has 20% of the time with the child and the other 80%, the parent with less time must be prepared to pay a considerable amount of child support, based on the theory that the parent who spends more time with the children has greater needs, covering expenses such as food, clothing, and other necessities.

Likewise, the misunderstanding about equal shared time or income remains: if both parents have the same income but one spends less time with the child, that parent must pay legal child support. Similarly, if both have equal shared time but different incomes, the higher earner is expected to pay support.

CS = K [HN – (H%) (TN)]

We will explain this equation as follows:

CS: The amount of child support to pay.

K: The portion of both parents’ income allocated to support.

HN: The net monthly income of the higher-earning parent.

H%: The approximate percentage of parenting time for the higher-earning parent.

TN: The total net monthly available income of both parents.

Additionally, it is important to know some of the various incomes and deductions that may affect the child support calculation.

Salaries/Wages:
These are income subject to employment tax. For child support cases, this is a gross amount before any tax deductions. People who receive a salary are given a W-2 form showing their income and pay periods. This income is considered salary/wages, and understanding the payment frequency is essential since it affects the average income calculation.

Biweekly:
People paid biweekly receive 26 paychecks per year, generally on the same weekday (usually Fridays). For example, if someone earns $5,000 per biweekly paycheck, multiplying by 26 pay periods results in an annual salary of $130,000, which divided by 12 months gives an average monthly income of $10,833.33.

Semi-monthly:
People paid semi-monthly receive 24 paychecks per year. For example, if paid $5,000 semi-monthly, multiplied by 24 equals $120,000 annually, divided by 12 months gives $10,000 monthly.

Self-Employment Income:
Self-employed people report earnings using a profit and loss statement. This type of income is not characterized like salary/wages. One way to know if someone is self-employed is if their paychecks show no tax withholding.

Voluntary Retirement Contributions:
Child support is calculated based on the parent’s net available income, but voluntary retirement contributions reduce taxable income. In other words, income not subject to tax does not increase net income, as higher net income means a higher child support payment.

New Spouse Income:
When a parent remarries, the spouse’s income must be disclosed as it increases net income, potentially benefiting the custodial parent. However, many consider it unfair that a spouse’s income is factored into child support.

Other Non-Taxable Income:
Basic housing and subsistence allowances for enlisted military personnel are considered income for child support. If a military member lives on base, the home is treated as tax-free property. California law defines available income for support as income from all sources. Disability benefits are non-taxable income; some are partially taxable, but usually, they are tax-exempt.

Health Insurance Premiums:
Health insurance premiums are not included in child support calculations. However, voluntary pre-tax contributions to health savings or flexible spending accounts are not considered insurance premiums.

Union Dues:
Like health premiums, union dues are deducted from net income and are not counted in child support calculations.

Child Support Paid for Other Relationships:
California law allows deducting court-ordered child support paid for other children from the net income. Voluntary payments may be approved if they follow legal guidelines and are comparable to support for other children.

Tax Returns:
How a parent files taxes affects child support calculations. For example, a head of household’s tax return differs from a single person’s. Income declarations may include overtime, bonuses, or other payments considered in child support calculations. The court is discreet in handling additional income.

When does child support start?

Child support orders begin under California law when one parent files a request.
