In Section 240: \u201cAn assault is an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another.\u201d<\/p><p data-start=\"317\" data-end=\"682\">When a person is accused of the crime of assault, certain elements must be present, such as that the aggression occurs when a person puts others at risk by causing fear of bodily harm or injury. It is not necessary for the accused person to have had direct contact with the victim, as long as there was a real intent to create a reasonable fear of harm to others.<\/p><p data-start=\"684\" data-end=\"782\">The important point is whether the person has or had the actual ability to carry out the threat.<\/p><p data-start=\"784\" data-end=\"1026\">The crime of assault can be classified as a MISDEMEANOR or a FELONY.
