Legal Definition
It is known as “the discharge of a firearm from a vehicle.” But this code prohibits more than attempting to shoot someone from a car and establishes that it is illegal:
Penalties
Knowingly allowing a passenger to carry a firearm in your car is a misdemeanor. It is punishable by up to 6 months in jail and/or a fine of up to $1,000.
Firing a gun from your car or allowing someone else to do so is a “wobbler” crime. This means the offense may be charged as either a misdemeanor or a felony.
- If convicted as a misdemeanor you face up to one year in jail and/or a monetary fine; the same penalties apply if it is charged as a felony.
