Definition

California Penal Code makes it a crime to make false reports of a fire. This section also prohibits tampering with, damaging, or breaking fire alarms or equipment such as fire extinguishers.

In terms of false alarms, this means making a report maliciously or recklessly.

This law explains that making a false report of a fire or destroying fire safety equipment is considered a misdemeanor. A judge may sentence a person to up to one year in county jail. However, if the false alarm causes bodily injury or death, it becomes a felony, which may result in a sentence of up to three years in California state prison.
